James Tupper tries to stop Anne Heche’s eldest son from becoming her brother’s guardian
James Tupper tries to make sure that Anne Heche’s eldest son does not become the legal guardian of his younger half-brother due to the ongoing family inheritance proceedings.
According to court documents obtained by Page Six, Tupper filed on Monday for recognition as the trial guardian of his 13-year-old son, Atlas Tupper, which he shared with the deceased actress.
The court appoints a probation officer who is to watch over someone in the course of the case. In this case, James does not want Heche’s 20-year-old son, Homer Laffoon – whom she shared with ex-husband Coleman Laffoon – to take control of some of her Atlas fortune.
“As a minor, Atlas has no way of employing a legal representative to represent his interests in these proceedings,” argued James in the paperwork, which states that they both currently live together.
James further noted that he is “the father and only living parent of Atlas”, adding that he “loves both Homer and Atlas as a father and wants the best for them.”
Last month, Homer applied to be appointed executor of the Heche estate. He asked that he and Atlas be named as the only heirs of their mother, and asked the court to appoint him as Atlas’s guardian.
James argued on Monday’s paperwork: “To maintain family harmony and a healthy, fraternal relationship between Atlas and Homer, and given the complexity that can be predicted, this property will include … a related, neutral, private professional trustee would be a more appropriate administrator.”
James had previously filed his own petition in response to Homer claiming that Heche had sent him an e-mail in January 2011 saying, “FYI in case I die tomorrow and someone asks.” My wish is that all my assets go under the control of Mr. James Tupper so that they can be used to raise my children and then passed on to the children. “
But Homer responded by saying the email “did not meet the legal requirements for a valid formal certified will” because “it was not signed by [Heche] and there are no two witnesses who signed the document in the process [her] life.”
Heche died on August 12 after a car accident on August 5 that left her in a coma with severe burns and severe injuries.
