James Tupper refused to custody of Atlas in a fight over the Anne Heche estate with Homer Laffoon
A California judge rejected James Tupper’s request to be appointed as his son’s legal guardian.
According to documents obtained by Page Six, the court found that Tupper – who shares Atlas with Anne Heche – had not provided enough evidence to stop Homer Laffon from becoming his half-brother’s legal guardian.
Following the ruling, Laffoon attorney Bryan L. Phipps told Page Six in a written statement: “We are pleased – but not surprised – with today’s court ruling rejecting James’s request to be appointed as Atlas’ legal guardian. We expect the court to hear Homer’s request at the next hearing, and in the meantime, Homer will continue to diligently manage the property in accordance with his powers as Special Administrator. “
The next court hearing will take place on November 30, 2022.
On August 31, Homer – Heche’s eldest son with Coleman Laffoon – applied to be appointed executor of his mother’s will, claiming that he was “the person with the highest priority of appointment” and “legally entitled to be appointed administrator.” ”
The 20-year-old demanded that he and his brother be listed as the sole heirs of their deceased actress before asking the court to appoint him as Atlas’ guardian.
Immediately afterwards, Tupper tried to stop Homer, arguing that “as a minor, Atlas has no way of recruiting legal representation to represent his interests in this proceeding.”
He added that he is the only living parent of Atlas, they live together and he “loves” his son “very much”.
Tupper continued in his petition: “To maintain family harmony and a healthy, fraternal relationship between Atlas and Homer, and given the complexity as can be predicted, this estate will include … a related, neutral, private professional trustee would be a more appropriate administrator.”
In addition to asking the court to appoint him as his son’s legal guardian, Tupper also claimed that he was executor of Heche’s will, according to an email she sent back to him in 2011.
“It is my wish that all my assets be under the control of Mr. James Tupper so that they can be used to raise my children and then passed on to the children,” she claimed to have written in a supposed will.
However, Homer fired and stated that the alleged will was invalid because “it had not been signed by [Heche] and there are no two witnesses who signed the document in the process [her] life.”
The actress “Six Days and Seven Nights” died on August 12 after a car accident on August 5 in which she fell into a coma. She was 53 years old.
