A California judge rejected James Tupper’s request to be appointed as his son’s legal guardian.

According to documents obtained by Page Six, the court found that Tupper – who shares Atlas with Anne Heche – had not provided enough evidence to stop Homer Laffon from becoming his half-brother’s legal guardian.

Following the ruling, Laffoon attorney Bryan L. Phipps told Page Six in a written statement: “We are pleased – but not surprised – with today’s court ruling rejecting James’s request to be appointed as Atlas’ legal guardian. We expect the court to hear Homer’s request at the next hearing, and in the meantime, Homer will continue to diligently manage the property in accordance with his powers as Special Administrator. “
