Trigger Warning: Explicit description of sexual assault.
Sean “Diddy” Combs wants Jane Doe’s sexual misconduct lawsuit dismissed.
According to TMZthe rapper moved to dismiss the complaint with prejudice, arguing that the statute under which he was suing Doe had expired.
Through her lawyers, Combs also insisted that the lawsuit contain no important details beyond the alleged assault.
He further believes that she included a “trigger warning” in her report to increase attention for her allegedly lewd claims.
“The few amendments to the original complaint do not remedy the lies and irremediable deficiencies of the new letter. Like the original complaint, it fails to state any valid claim and must be dismissed,” Combs’ filing reads, according to TMZ.
“Plaintiff cannot state what day or time of year the alleged incident occurred, however, he states that he miraculously and in detail recalls the most salacious details. Accordingly, the case must now be dismissed, with prejudice, to protect Defendants Combs from further reputational harm and before more of the parties’ and judicial resources are wasted.”
Doe filed the lawsuit in December 2023 — shortly after Combs settled a rape and molestation lawsuit filed by ex-girlfriend Cassie — alleging she was sex trafficked, drugged and gang-raped in 2003 when she was 17 years old.
Doe claimed she met Harve Pierre, former president of Combs’ Bad Boy Entertainment record label, at a Detroit nightclub. Pierre allegedly told her she was “hot” and that Combs would love to meet her.
Pierre then allegedly called Combs and put Doe in touch with the producer, who told her she should fly with Pierre to New York.
She agreed; however, she claimed that she was forced to provide Pierre – who smoked crack – with oral sex before boarding.
After landing, Doe claimed she was taken to Combs’ recording studio, where Combs, Pierre, and a third attacker who had flown in with her and Pierre plied her with drugs and alcohol.
“In the studio, Ms. Doe was gang-raped by Mr. Combs, the third assailant, and Mr. Pierre, in that order,” the complaint alleged.
Doe alleged that Combs removed her underwear and forced himself on her while she was “hanging” over the bathroom sink.
He then allegedly “watched as a third attacker, whom Ms. Doe was not even aware of, began having sex with her, raping Ms. Doe when she told him to stop.”
Pierre then allegedly “raped Ms. Doe and then brutally forced her to perform oral sex, during which Ms. Doe choked and had difficulty breathing.”
Doe claimed she “fell into the fetal position” and “her vagina hurt.”
She added that after the alleged gang rape she was “barely able to stand” and was helped into a car that took her back to the airport. She said she had “limited” memory of returning to Michigan.
Doe’s lawsuit included various photos that “were taken at the studio that night, leaving no doubt that Ms. Doe was with Mr. Combs at Mr. Combs’ New York studio the night she was raped.”
Combs is being sued by three other women and one man over similar claims, which he vehemently denies.
The tycoon is also at the center of a federal sex trafficking investigation; in March, the Department of Homeland Security raided his homes in Los Angeles and Miami.
Despite this, he was not charged with a crime.
