At approximately 2:25 a.m., the suspect, who is 31 years old and a native of the Bronx, got into an argument with three other men. The argument, which initially took place verbally, quickly escalated into a physical altercation. A few hours later, Palacios took an ax from his rucksack in a nonchalant manner and began threatening other people present at the McDonald’s exit.
An eyewitness recorded Palacios on tape wielding an ax wreaking havoc inside the Delancey Street McDonald’s location, terrifying customers and causing extensive property damage. The video was captured by a witness. Even with the ax still in his hand, he approached a terrified woman and said to her:
“Do not be afraid of me; your fear must be directed at him!”

Some observers urged him to take a deep breath and relax. The sudden, violent explosion did not result in any injuries for any of the people present at the McDonald’s restaurant, as the police said.

“The suspect pulled out an ax from his bag and threatened unknown people. The suspect intentionally harmed the property of the establishment. The man in question was taken into custody by responding officers. During the search conducted as part of his legitimate arrest, an additional knife was found in his rucksack. The victims did not report any injuries.
The NYPD arrested Palacios, who was subsequently charged with one count of criminal mischief, three counts of intimidation, and two counts of criminal possession of a weapon.
