Ezra Miller pleaded not guilty to one count of burglary and one count of petit larceny in Vermont Superior Court on Oct. 17, their attorney confirmed to E! News.

The lawyer also noted that the star of the upcoming film Flash, 30, accepted the conditions set by the court not to contact the residents and not to enter the house of the alleged incident. The next hearing in Miller’s case is scheduled for January 13.

“Ezra would like to acknowledge the love and support they have received from their family and friends,” the attorney said in a statement to E! News, “which continue to be a vital presence in their ongoing mental health.”

The charges stem from a May 1 incident in Stamford, Vermont, when officers were called to a burglary complaint.

“Initial findings indicated that several bottles of alcohol were stolen from the residence while the home owners were away,” Vermont State Police said in an August release. “An investigation that included surveillance video and statements led to probable cause to charge Ezra M. Miller with burglary of an unoccupied residence.”

Miller was located on Aug. 8 and issued a summons to appear in Vermont Supreme Court for an arraignment that was originally scheduled for Sept. 26 and later rescheduled for Oct. 17, the release said.
