James goes on to say that by spring 2022 the deal had been “broadly negotiated, agreed orally and confirmed in writing in a series of phone calls and e-mails between plaintiff and defendant authorized representatives.”

However, SiriusXM and Stitcher allegedly sent an e-mail to the “Labor Day” actor in April, informing him that while they were “ready to officially end the terms,” ​​someone in senior management reviewed the contract and eventually waived the contract.

James goes on to say that during the Zoom call in July, the company officially “waived” the contract, citing a “new policy” in which the finance team reviews all contracts and can decide whether things go ahead or not, and they decide whether or not to “decline this agreement”.

The actor believes that SiriusXM / Stitcher should continue to be responsible for paying him at least the expected minimum, in addition to “general and compensatory damages” and attorney’s fees.
